Code of Ethics of the American Academy of Mexican Law Experts
(as adopted on December 13, 2022)

Preamble

As a mandatory requirement of membership in the American Academy of Mexican Law Experts (the “Academy”), all Members of the Academy pledge to abide by this Code of Ethics to ensure that they effectively deliver expert opinions and serve in the capacity as a neutral expert in a manner consistent with the goals of the Academy.

Standards of Conduct

  1. Loyalty to the truth. Members of the Academy owe a duty of loyalty to the truth in all their work as experts in Mexican law that supersedes any obligations they may have to the party or counsel that retains them or pays their fees. Members’ expert opinions must reflect the expert’s independence, impartiality, objectivity, and integrity.
  1. Duty to the court. Academy Members, as lawyers, are officers of the court. When testifying, in writing or in person, the core role of the expert in Mexican law is to assist the court in understanding Mexican law and the Mexican legal system and to remain neutral as between the parties. 
  1. Independence. Academy members are not advocates for the parties that engage them. In performing their work, including in researching the applicable law, formulating opinions, drafting affidavits or declarations and testifying live in deposition or court, Academy Members shall preserve and maintain the independence of their work and shall not permit the parties or counsel with whom they work to dictate or alter the Member’s opinions, work product or testimony.
  1. Integrity. Academy members shall avoid entering into any arrangement which could compromise their integrity, objectivity, and neutrality as experts.  The payment of Academy members’ fees shall not depend on the substance of the opinions they reach or on the outcome of the case at hand and their engagement agreements shall include a statement to that effect.  Members shall not accept any benefits for their expert testimony other than compensation for their expert time and reimbursement for expenses incurred.     
  1. Professional conduct. Academy Members pledge to comply with the Code of Ethics of any professional bar association of which they are a member.
